The New H1B Registration Process and How It Will Work

DHS has confirmed the registration process will begin March 1st and will close March 20th unless extended by DHS. Once the registration window closes, DHS intends on completing the CAP lottery count and informing the employers of individuals who made it into the lottery by March 31st.  Therefore, employers must register their employees for the Cap between March 1st and March 20th. The registration window will most likely close on March 20th. DHS is allowing companies to register their company account into the FLAG System before the registration period starts. The exact date of when this will be allowed is yet to be announced. In addition, the period within which the subsequent full H-1B petitions for cases that make it into the lottery can be filed is yet to be announced.

How to Register for H1B Lottery

In order to register the company as the principal employer account, the below information is required: 

  • The petitioning company’s legal name, Doing Business As name, employer identification number and primary U.S. office address.
  • Name, title, phone and email address of the authorized signatory.

In order to register the employee as a beneficiary of the H-1B Cap, the following information is required:

  • The H-1B candidate’s name, gender, date of birth, country of birth, country of citizenship, passport number, and whether he or she has a master’s degree or higher from a U.S. institution.
  • An attestation by the authorized signatory, under penalty of perjury, that the information is true and correct, and that the petitioner intends to file an H-1B petition for the individual H-1B candidate if selected in the lottery.

Our Application Process

In order to register the employee for the H-1B Lottery, we will be following our normal procedure of analyzing the candidate’s credentials and the job offered to ensure the employee will qualify and assess the level of complexity of the case. This is important because we need to ensure that we will be able to get the actual H-1B petitions approved for individuals that make it into the lottery. The initial review and analysis will also allow us to assess future options for the employees and develop a future strategy for them in the event they do not make it into the lottery. Only relying on the above-mentioned information to register without performing the necessary review and analysis will most likely lead to a higher risk of a Request for Evidence “RFE”. This will create additional work for the employer to respond to the RFE, and a higher chance of the H-1B petitions being denied. As such, once we have the list from you of the cases you want to file, we will send a checklist to the employer and employee requesting the needed documentation. The request will include the employee’s educational documents, resume, and information about the offered position including title, duties, salary and worksite location.
